Terms of Service & EULA

1. Acceptance of Terms

By downloading, installing, accessing, or using the Velia mobile application ("Velia", "the App", "we", "us"), you agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use or access Velia.

2. Medical & Non-Contraceptive Disclaimer

Please review this section carefully before relying on any information within the application:

• Informational Awareness Only: Velia is designed solely as a self-awareness tool for recording cycle observations, basal temperatures, and pregnancy milestones. It is not clinical diagnostic software, a medical device, or a healthcare service.
• Never Use for Contraception: Algorithmic predictions for ovulation, fertile windows, and menstruation are statistical estimates based on historical inputs. Stress, illness, travel, and biological variability can alter cycle timing unexpectedly. Velia must never be used to prevent pregnancy or as natural birth control.
• Professional Medical Advice: Insights, articles, and logs do not constitute medical advice or clinical diagnosis. Always consult a board-certified physician, obstetrician, or gynecologist regarding health conditions, conception planning, or unusual cycle symptoms.

3. Subscriptions & Billing (Apple EULA)

Velia offers auto-renewable premium subscriptions ("Velia Premium" / "Velia Elite") to access advanced algorithmic predictions, customizable cycle sharing, and unlimited clinical exports:

• Billing & Payment: Payment will be charged to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing cycle.
• Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• Free Trial Terms: If a free trial (e.g. 7-day trial) is offered, you will not be charged if you cancel at least 24 hours before the trial ends. Any unused portion of a free trial period is forfeited upon subscription purchase.
• Managing & Cancelling: Subscriptions are managed directly by you. You can cancel or modify your subscription at any time by going to your iOS device Settings → Apple ID → Subscriptions.
• Refunds: All purchases and refunds are processed directly by Apple under Apple Media Services Terms and Conditions (reportaproblem.apple.com).

4. Intellectual Property & Limited License

Velia grants you a revocable, non-exclusive, non-transferable, limited personal license to install and use the App on iOS and watchOS devices that you own or control.

All trademarks, logos, emblems, screen layouts, color palettes, animations, typography, software code, and sound effects are the exclusive intellectual property of Velia and its licensors. You may not reverse-engineer, decompile, copy, or redistribute any portion of Velia.

5. User Responsibilities & Device Security

You are responsible for entering accurate data into Velia. Because Velia stores health entries in your device's local sandbox, you are solely responsible for maintaining physical and biometric security (Face ID, Touch ID, device passcode) on your device. Velia provides an optional in-app biometric lock in Settings for additional privacy.

6. Disclaimer of Warranties

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELIA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT PREDICTIONS WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED OR ERROR-FREE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VELIA, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO UNPLANNED PREGNANCY, DELAYED MEDICAL TREATMENT, HEALTH COMPLICATIONS, LOSS OF DATA, OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APPLICATION.

8. Governing Law

These Terms shall be governed by and construed in accordance with standard Apple End User License Agreement (EULA) provisions and applicable consumer protection and privacy laws.
